A short guide to apartment leases in Egypt

What an apartment lease has to contain

Every residential lease rests on four elements it cannot be valid without: the two parties, the property, the term, and the rent. Everything else is a term the parties agree freely โ€” and in practice those are the clauses that settle a dispute when one arises.

  • Full details for both parties: name, national ID number, address, and phone number.
  • A precise description of the property: unit number, floor, full address, room count, and area.
  • The term, as a specific start date and end date, plus how renewal works.
  • The monthly rent in figures and in words, when it falls due, and how it is paid.
  • The deposit โ€” when it is returned, and what may be deducted from it.
  • Maintenance obligations, who pays the utility bills, and whether subletting is allowed.

Which law governs a lease signed today?

Contracts signed after 31 January 1996 fall under the Civil Code, after Law 4 of 1996 ended the application of the old rent-control statutes to new contracts. In practice that means the term and the rent are whatever the two parties agree, and the lease ends when its term ends.

What Egyptians call "old rent" applies only to contracts predating that date. Those follow an entirely different regime, itself recently amended by parliament. A contract drawn up here is a new contract by nature, so it grants the tenant no statutory extension once the term runs out.

Does the contract have to be registered?

The contract is valid between the parties the moment they both sign it; nothing about its formation depends on registering it anywhere. But a signature alone is no protection if the other side later denies it in court โ€” that is where an easily proved contract parts ways with a hard one.

Which is why many people take the contract through a signature authentication (ุตุญุฉ ุชูˆู‚ูŠุน) at the real-estate registry: a cheap, straightforward step establishing that the signature is genuinely the signer's, and one that makes proving the contract far easier in a dispute. The contract also gets asked for in practical settings โ€” connecting utilities, or changing the address on an ID.

Rent, deposit, and annual increases

The market norm is a deposit of one to two months' rent, returned when the tenant vacates, less whatever is owed for bills or damage. Write the return date and the permitted deductions into the contract explicitly โ€” of every clause in a lease, this is the one that generates the most arguments.

Annual increases are entirely a matter of agreement in new contracts, so fix the percentage in the contract rather than leaving it to be negotiated at each renewal. Note too that rental income is taxable, and declaring it is the landlord's responsibility.

Furnished apartment rental contract versus unfurnished

The difference is less in the wording of the contract than in what is attached to it: a furnished lease needs an inventory signed by both parties, itemising each piece, how many there are, and its condition on handover.

Common mistakes in rental contracts

  • Writing the rent in figures but not in words, which leaves the number open to alteration.
  • Omitting the end date, or writing "one year" without pinning down the first and last day.
  • Not saying who pays for maintenance, the building association, and the utility bills.
  • Signing a single copy. The rule is at least one original per party.
  • Leaving blanks in the contract unstruck after signing.
  • Not reading the electricity, water, and gas meters on handover day and recording them in the contract.

Rental contract wording: other versions of the contract

The template here is written for a residential apartment, which is what most people need. You can reword clauses, drop them, or add your own to cover other situations:
